Our Website is not intended for children under 16 years of age. No one under age 16 may provide any information to or on the Website. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on this Website or on or through any of its features, register on the Website, make any purchases through the Website, use any of the interactive or public comment features of this Website or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. We may collect, use, store and transfer several types of information from and about users of our Website which we have grouped together as follows:

  • Identity Information includes first name, maiden name, last name, username, or similar identifier.

  • Contact Information includes billing address, email address, and telephone numbers.

  • Financial Information includes bank account, PayPal, and payment card details.

  • Transaction Information includes details about payments from you and other details of products and services you have purchased from us.

  • Technical Information includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this Website.

  • Profile Information includes your username and password, purchases or orders made by you, your interests, and preferences.

  • Usage Information includes information about how you use our Website.

  • Marketing and Communications Information includes your preferences in receiving marketing from us and our third parties and your communication preferences.

Information by which you may be personally identified and any other identifier by which you may be contacted online or offline is considered “personal information.” We also collect, use, and share Aggregate Information such as statistical or demographic information for any purpose. Aggregated Data could be derived from your personal data but is not considered personal data in law as this data will not directly or indirectly reveal your identity. For example, we may aggregate your usage information to calculate the percentage of users accessing a specific feature of the Website. However, if we combine or connect Aggregated Information with your personal information so that it can directly or indirectly identify you, we treat the combined data as personal information which will be used in accordance with this privacy policy.

We do not collect any Special Categories of Personal Information about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health, and genetic and biometric data). Nor do we collect any information about criminal convictions and offenses.

  • Information that you provide by filling in forms on our Website. This includes information provided at the time of registering to use our Website, subscribing to our courses or blog, posting material, or requesting further services.   • Records and copies of your correspondence (including email addresses), if you contact us.

  • Details of transactions you carry out through our Website and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Website.

User Contributions. You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Website or transmitted to other users of the Website or third parties (collectively, “User Contribution”). Your User Contributions are posted on and transmitted to others at your own risk.   • To fulfill the purpose for which you provide it. 

  • For any other purpose disclosed by us when you provide the information.

  • With your consent.

We may also disclose your personal information:

  • To enforce or apply our Terms of Service and other agreements, including for billing and collection purposes.

  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of SWIHM, our customers, or others.

IX.  Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information: 

  • Promotional Offers from the Company. If you do not want us to use your contact information to promote our own products and services, or third parties’ products or services, you can opt out by replying to any promotional email we have sent you or following the opt-out links on that message.  

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of this Website may then be inaccessible or not function properly.

  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt out as provided in Contact and Opt-Out Information below.

We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. You can opt out of receiving personalized ads from advertisers and ad networks that are members of the Network Advertising Initiative (“NAI”) or who follow the DAA Self-Regulatory Principles for Online Behavioral Advertising using their respective opt-out tools. X.   Accessing and Correcting Your Information

You can review and change your personal information by following the instructions below: 

Courses. SWIHM uses the third-party learning management platform Teachable to host our courses. If you have enrolled in a SWIHM course, go to courses.swihm.com and log in to your account. Click on your user avatar and select "Edit Profile." If you are using a myTeachable account, click "Edit Profile" to change your information that you may have chosen to use with Teachable (see Teachable's Privacy Policy and Terms of Use).  

Emails. SWIHM uses the third-party ecommerce customer relationship management platform Drip for email communications and marketing. If you would like to edit the information we use for marketing purposes, click the “unsubscribe” link at the bottom of an email from us, then click “Update My Details.” (See also Drip’s Privacy Policy and Terms of Service.)

CARE-writer. SWIHM uses the third-party authentication and authorization service provider Auth0 to manage user accounts for CARE-writer. To change the information you use with CARE-writer, log into your account at app.care-writer.com. (See also Auth0’s Privacy Policy and Terms of Service.)

You may also send us an email at support@swihm.freshdesk.com to request access to, correct, or delete any personal information that you have provided to us. We cannot delete your email address and name except by also deleting your user account. If you would like to delete one account but maintain another (for example, if you would like us to delete your account with CARE-writer, but maintain an account with the SWIHM School), please specify for which account you would like the information deleted. Otherwise we will delete all of your information across all accounts. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

If you delete your User Contributions from the Website, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Website users.  Proper access and use of information provided on the Website, including User Contributions, is governed by our Terms of Service

XI.  Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website who are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. 

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website. 

XIII. Changes to Our Privacy Policy

It is our policy to post any changes we make to our Policy on this page with a notice that the Policy has been updated on the Website home page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the primary email address specified with your account and/or through a notice on the Website’s home page. The date the Policy was last revised is identified at the top of the page. You are responsible for ensuring we have an up-to-date, active, and deliverable email address for you, and for periodically visiting our Website and this Policy to check for any changes.

XIV. Consent to Transfer and Storage in the United States

SWIHM is a United States company. If you are visiting this Website from outside the United States, please be aware that you are sending information (including personal information) to the United States or other countries where our servers are located. By using the Website, or providing us with any information, you fully understand and unambiguously consent to this transfer, processing, and storage of your information in the United States and other jurisdictions, which may not have data protection laws as comprehensive or protective as those in your country of residence or where you are a citizen. As a result, this information may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to laws in those jurisdictions. XV.  INFORMATION FOR PERSONS IN THE EUROPEAN UNION AND EUROPEAN ECONOMIC AREA

This section of the Policy applies only if you use our Website or otherwise provide us with personal data from a country that is a Member State of the European Union or European Economic Area (collectively, “EU”), and it supplements the information in the remainder of our Policy, above. 

SWIHM is a “controller” as that term is defined in the General Data Protection Regulation (“GDPR”) and other relevant data protection laws. Our contact information is in Contact and Opt-Out Information.  We do not knowingly sell our services to children under the age of 16.

We will not use your personal data for taking any automated decisions affecting or creating profiles other than as described above.

  • Disclosure of your Personal Data. We will disclose your personal data as set forth in Disclosure of Your Information above.

  • Change of Purpose. We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us as set forth in Contact and Opt-Out Information.

    If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

    Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

  • EU Data Subject Rights and Data Retention. The GDPR provides certain rights for EU data subjects. You can access information about you and update or correct it. In some cases, you can also ask us to erase it, restrict or stop processing, or provide data in a “portable” form, if feasible. You may also decline to share certain personal data with us, in which case we may not be able to provide some of the features and functionality of our Website.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

We retain your personal data while you have an account with us and while you continue to use or visit the Website. We will retain your personal data for as long as it is reasonably necessary for the purposes set out in this Policy, considering the time period reasonably necessary to provide our services to you; exercise the choices and rights you have requested; comply with our contractual obligations; enforce our Terms of Service; and, comply with legal and regulatory requirements. 

You may make changes to the personal data collected by our account registration pages as described in the Accessing and Correcting Your Information section above. We will make commercially reasonable efforts to provide you reasonable access to your personal data within one month of your access request to the contact address below. We provide this access so that you may review, make corrections, or request deletion of your personal data. If we cannot honor your request within one month, we will inform you when we will be able to provide such access. If for some reason access is denied, we will provide an explanation as to why access is denied. When technically feasible, at your request, we will provide your personal data to you or transmit it directly to another controller.
